1. Agreement to Terms
By accessing and using the services of JobBuddy Workforce Solutions ("JobBuddy," "we," "us," or "our"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services.
2. Services Provided
JobBuddy provides workforce solutions including but not limited to:
- Permanent staffing and recruitment services
- Contract staffing solutions
- Bulk hiring and workforce deployment
- Compliance management services
- Job placement assistance for candidates
- Digital marketing training and courses
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.
3. User Accounts and Registration
3.1 Account Creation
To access certain features of our services, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.
4. User Responsibilities
4.1 For Employers
Employers using our services agree to:
- Provide accurate job descriptions and requirements
- Comply with all applicable labor laws and regulations
- Maintain a non-discriminatory hiring process
- Honor compensation and benefits commitments made to placed candidates
- Provide timely feedback on candidate submissions
- Pay agreed-upon fees for successful placements or services rendered
4.2 For Job Seekers
Job seekers using our services agree to:
- Provide truthful and accurate information in all submissions
- Maintain professional conduct during interviews and communications
- Notify us immediately of any change in job-seeking status
- Not misrepresent qualifications, experience, or credentials
- Attend scheduled interviews and meetings unless properly notified in advance
5. Fees and Payment
5.1 Service Fees
Fees for our services will be communicated to employers during the engagement process. All fees are exclusive of applicable taxes unless otherwise stated.
5.2 Payment Terms
Payment is due within the timeframe specified in the service agreement. Late payments may be subject to interest charges and may result in suspension of services.
5.3 No Fee for Job Seekers
JobBuddy does not charge fees to job seekers for placement services. Any training programs or courses offered will have separate terms and pricing clearly communicated.
6. Intellectual Property
All content, features, and functionality on our website and services, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of JobBuddy or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit for any commercial purpose any portion of our services without our express written permission.
7. Confidentiality
Both parties agree to maintain the confidentiality of any proprietary or confidential information disclosed during the course of our services. This includes but is not limited to:
- Candidate information and resumes
- Employer business strategies and requirements
- Compensation details and negotiations
- Any information marked as confidential
8. Prohibited Conduct
You agree not to:
- Use our services for any illegal purpose or in violation of any laws
- Circumvent JobBuddy to directly hire candidates we have introduced
- Post or transmit any content that is defamatory, obscene, or offensive
- Interfere with or disrupt our services or servers
- Attempt to gain unauthorized access to any part of our services
- Engage in any form of automated data collection or scraping
- Impersonate any person or entity or misrepresent your affiliation
9. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
While we strive to provide quality candidates and placements, we do not guarantee employment outcomes or the performance of placed candidates.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBBUDDY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability for any claims arising from or relating to our services shall not exceed the amount paid by you to us for the services in question during the twelve (12) months prior to the event giving rise to liability.
11. Indemnification
You agree to indemnify, defend, and hold harmless JobBuddy and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:
- Your access to or use of our services
- Your violation of these Terms of Service
- Your violation of any third-party rights
- Any information or content you submit through our services
12. Termination
We reserve the right to terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms of Service.
Upon termination, your right to use our services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
13. Governing Law and Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Any disputes arising from or relating to these terms or our services shall be subject to the exclusive jurisdiction of the courts located in India.
14. Dispute Resolution
In the event of any dispute arising from or relating to these Terms or our services, the parties agree to first attempt to resolve the dispute through good faith negotiations.
If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through mediation or arbitration before resorting to litigation.
15. Changes to Terms
We reserve the right to modify or replace these Terms of Service at any time at our sole discretion. We will provide notice of any material changes by posting the new Terms on this page and updating the "Last Updated" date.
Your continued use of our services after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
17. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and JobBuddy regarding the use of our services and supersede any prior agreements.
